3 petitions vs. Bongbong prexy bid lodged in Comelec First Division, summons issued

The Commission on Elections (Comelec) have raffled the three petitions seeking to disqualify former senator Ferdinand Marcos, Jr. in the 2022 elections to its First Division, poll commissioner Rowena Guanzon said.

The disqualification cases which will be deliberated in the Comelec First Division include:

  •     the petition filed by Bonifacio Ilagan Campaign Against the Return of the Marcoses and Martial Law (CARMMA) and religious and youth rights advocates,
  •     the petition filed by Akbayan Citizens’ Action Party, and
  •     the petition filed by Abubakar Mangelen claiming to be the duly-elected chairman of the PFP and that the CONA issued to Marcos Jr. is “unauthorized, defective, invalid and void.”

“All the three summons in three cases in First Division have been served. Preliminary conference [is set] on January 7, 2022,” Guanzon, one of the three members of the First Division, said.

“Akbayan petition looks better than the others,” she added.

Both the petitions of Akbayan and CARMMA and allied groups argue that the four violation of Tax Code convictions of Marcos, Jr. handed by the Court of Appeals carry a penalty of perpetual disqualification from public office, among others, since the violation was committed when he was the governor of Ilocos Norte from 1982 to 1985.

The petitioners cited Section 252 of the Tax Code which provides that the maximum penalty prescribed for the offense of violating Tax Code for public officials and employees is dismissal from public service and perpetual disqualification from holding any public office.

In August 2001, Marcos, Jr.’s convictions for violating Tax Code became final by virtue of the entry of judgment of the Resolution of the Supreme Court granting his motion to withdraw his earlier motion for extension of time to file a petition for review on certiorari.

The Akbayan petition, however, only seeks disqualification of Marcos, Jr. while the CARMMA and allied groups’ petition is seeking disqualification of Marcos, Jr. or cancellation of Marcos Jr’s certificate of candidacy (COC) and such COC be denied due course.

Marcos, Jr. is the son of the late dictator President Ferdinand Marcos. His 2022 presidential bid comes 35 years after their family was ousted from power via the bloodless People Power revolution.—AOL, GMA News
